What is Expunction/Expungement?
An expunction wipes clean all information pertaining to an arrest for a misdemeanor or felony from a person's permanent criminal record.
Who is Eligible?
- Parties who were aquited after trial
-Parties who were arrested but never charged
-Parties who have been pardoned by the govenor
-Parties who were released after the charges against them were dropped
Who is Ineligible?
You are Ineligible if you have been convicted of a felony within the five years preceding the offense that you are now seeking to have removed from your permanent criminal record. If you were given deferred adjudication, you are not eligible for expunction, you may pursue a petition for non-disclosure, which enables you to seal your record.
What Happens After you obtain and Expunction?
All government agencies and entities are required to remove relevant information from their files. In addition you can answer "NO" when asked on applications or during interviews whether you have been arrested.
NOTE: If the charges against you were dismissed, you may not seek an expunction until the Statue of Limitations applicable to the offense have expired.
